1. 01Who these terms are with

   Smash Peptides is a trading name of S.P Fitness Gains, ABN 93 423 372 506 ("we", "us", "our"). These terms of supply govern every order placed through smashpeptides.com.au.

   By placing an order you agree to these terms. If you do not agree with them, do not order. You can reach us at smashpeptides@gmail.com.

2. 02Research use only — the condition of every sale

   Every product we supply is sold strictly as a laboratory research chemical. Products are not medicines, not supplements, not food, and not cosmetics. They have not been assessed by the Therapeutic Goods Administration for safety, quality or efficacy, and they are not entered on the Australian Register of Therapeutic Goods.

   This is a condition of sale, not a disclaimer. If you intend to use a product for any purpose described below, we will not supply you.

   • Not for human consumption, injection, inhalation, topical application or any other administration to a person.
   • Not for veterinary or animal use.
   • Not for therapeutic, diagnostic, preventative or cosmetic use.
   • Not for resupply to any person who intends any of the above.
   • Not for use in any food, beverage, supplement or consumer product.

3. 03Who we will supply

   By placing an order you represent and warrant that each of the following is true. If any of them is not true, you must not order.

   • You are at least 18 years of age.
   • You are ordering for genuine laboratory research purposes.
   • You are appropriately qualified, or acting under the supervision of someone appropriately qualified, to handle research chemicals safely.
   • The products will be received, stored, handled and disposed of in an appropriate research setting.
   • You are responsible for determining and holding any licence, permit, authorisation or approval your intended use requires, and for complying with every law that applies to you.

4. 04We make no claims about what these products do

   We publish the name, size, batch number, purity, testing date and certificate of analysis for what we sell. That is the whole of what we assert.

   We make no representation about the effect, benefit, safety, suitability or outcome of any product, for any purpose, in any subject. We do not provide dosing information, protocols, administration guidance, or medical, veterinary or scientific advice, and nothing on this site should be read as any of those. Any information you find elsewhere about these compounds is not ours and we do not adopt it.

5. 05Certificates of analysis — what they do and do not mean

   We publish a certificate of analysis for tested batches. A certificate reports what an independent laboratory measured in a sample of a specific batch: identity, purity, content and, where reported, heavy metals.

   A certificate is evidence about the material tested. It is not an approval, an endorsement, a safety assessment, or a statement that the product is fit for any use. Where a certificate covers only some sizes of a product, the site says so, and no purity figure is claimed for a size that has not been tested.

6. 06Orders and acceptance

   Your order is an offer to buy. A contract is formed only when we confirm your order after payment clears. We may decline any order, in whole or in part, without giving reasons — including where we believe the intended use breaches these terms.

   When you place an order we hold the stock for three business days pending payment. If payment has not cleared in that time the stock is released and the order may be cancelled.

   If a product is listed at an incorrect price or with an obvious error, we may cancel the affected order and refund you in full rather than supply at that price.

7. 07Prices, GST and payment

   Prices are in Australian dollars and include GST. Shipping is charged separately and is shown before you confirm. Prices may change at any time, but a change will not affect an order we have already confirmed.

   We accept payment by Australian bank transfer only. We do not accept card payments, and we never ask for card details. At checkout you are given our account details and a unique payment reference — quote it, or we cannot match your payment to your order.

   Bank details shown anywhere other than on our checkout page or in an email sent from our own domain should be treated as fraudulent. If our details appear to have changed, contact us before transferring anything.

   Title in the goods passes to you on receipt of cleared funds. Risk passes to you on delivery.

8. 08Delivery

   Delivery, dispatch times and what happens to a lost or damaged parcel are set out in our Shipping and Returns policy, which forms part of these terms.

9. 09Returns

   Your return rights, and the consumer guarantees that sit above them, are set out in our Shipping and Returns policy, which forms part of these terms.

10. 10Your rights under the Australian Consumer Law

    Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

    Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

11. 11Limitation of liability

    Subject to the section above, and to the fullest extent the law allows, our total liability arising out of or in connection with a product or these terms is limited, at our option, to replacing the product or refunding the price you paid for it.

    To the fullest extent the law allows, we are not liable for any loss, injury, harm, expense or damage arising from use of a product otherwise than as a laboratory research chemical, including any administration to a person or animal.

12. 12Your indemnity

    You indemnify us against any claim, loss, liability or expense we incur arising from your breach of these terms, from your use or handling of a product otherwise than as permitted by these terms, or from your supply of a product to any other person.

13. 13Privacy

    We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.

14. 14Changes to these terms

    We may change these terms at any time by publishing an updated version on this page. The terms that apply to your order are the ones published when you placed it. The date at the top of this page tells you when it last changed.

15. 15Governing law

    These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the Commonwealth of Australia.
